AFFILIATE PARTNERS TERMS & AGREEMENTS
Overview
This Agreement contains the complete terms and conditions that apply to you becoming an Affiliate Partner with Platinium Group. Please note that throughout this Agreement, "we," "us," "our" and the Company will mean Platinium Group, and "you," "your," and "yours" will mean the Affiliate.
As an Affiliate, your site cannot contain content that could be classified as defamatory, harassing, harmful, obscene, racially objectionable, unlawful or otherwise violate intellectual property rights.
Should your website be in breach of the terms in this Agreement, we will terminate the Agreement without further notice and you will not be eligible for any or all benefits and revenues arising from sales on your website via Platinium Group’s “white label” program.
Monitoring
We have the right to monitor your site at any time to determine if you are following the terms and conditions of this Agreement. You are responsible for making any changes as deemed reasonable.
Affiliate Site
When a customer visits any of the pages on the white label of your website by clicking on the TICKETS link, your unique Affiliate ID follows the customer as he/she browses through and makes a purchase. Any order made by this customer will therefore include your unique Affiliate ID.
Content Usage on the Affiliate Site
Usage of iFrame Ticket Shop on Affiliate Site: As a White-Label Affiliate Partner, you have the option to insert the full Gootickets Ticket Shop into your website design. This is only allowed as is, and the ticket shop content is not allowed to be modified in any way.
Usage of Images: You may not copy and use images directly from the Gootickets site (with the only exception being the iFrame Ticket Shop integration).
Use of text content: You may not copy and use any texts, including but not limited to product descriptions, supporting pages or legal documents, directly from the Gootickets site (with the only exception being the iFrame Ticket Shop integration).
Use of Maps: You may use the maps from the Gootickets website for guidance, and may use them for editorial purposes on your site, without any modification. You cannot, for example, remove the Gootickets logo from the map and publish it as your own. You may publish the maps on your site and in social media, but must then give proper copyright disclosure to Gootickets by indicating the source of the image by either including our social handles or include the link to our website.
Breach of Content Policy
If you breach any of the content policy terms stated in this text, we reserve the right to:
Withhold your commission from any sales you made from the time of the discovery of the breach until you have fulfilled requirements of removal or correction determined by Platinium Group.
If our directions in point 1 are not followed within the determined time frame, you will be subject to plagiarism and copyright infringement, which will lead us to take legal actions.
Policies for Bookings and Purchases
Customers’ information collected through the purchase of tickets via the link on your website will be considered customers of the Company, and our Privacy Policy will protect their personal details. We will be responsible for all aspects of order processing and fulfilment. Among other things, we will process payments, and cancellations, and handle customer service. We will track sales made to customers who originate from your site and who purchase tickets and will make reports available to you summarizing this sales activity. The form, content, and frequency of the reports will be every two months and may vary at our discretion.
Commission Fees
You will receive your commission of 2.5%, solely on all sport/event ticket orders made via your website. Additionally, if the Affiliate Partner decides to add a mark-up on top of our set ticket prices (extra margin on ticket price), we will pay the corresponding commission due.
We will pay your commission every two months, with a minimum invoicing amount of 100€. Payment will be only in Euro currency paid by Bank Transfer, any applicable fees will be at the charge of the payee. To minimize such costs, we can differ your commission transfer payments from every two months to every 4 or 6 months.
Gootickets reserves the right to refuse payment of commission and/or deactivate the affiliate account if the Affiliate does not respect the general terms and conditions.
Policies and Pricing
Accordingly, all Platinium Group rules, policies, and operating procedures concerning customer orders, customer service, and product sales will apply to all customers. We may change our policies and operating procedures at any time. For example, we will determine the prices to be charged for tickets sold under this Program in accordance with our own pricing policies. You may choose to augment these prices to increase your returns (mark-up). Ticket prices and availability may vary from time to time. You may view the information of orders made through your site, however under our Privacy Policy you may not view or receive personal information of the customers themselves.
You are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. In addition, you may not in any manner misrepresent or embellish the relationship between us and you, or express or imply any relationship or affiliation between us and you or any other person or entity except as expressly permitted by this Agreement (including by expressing or implying that Platinium Group supports, sponsors, endorses, or contributes money to any charity or other cause).
Customer Communication
All communication toward customers, delivery and customer service will be handled by Gootickets.com.
Cookies and tracking In order to track sales and commissions from Affiliate sites, Platinium Group uses an Affiliate Tracking Cookie. The affiliate program cookie connects the visitor with the Affiliate and defines how long the connection is valid after a visitor clicked on an affiliate link. If a customer buys a product within the defined time, the Affiliate will get commission for this sale. If a tracked customer makes a purchase after this period, commissions will not be assigned to affiliate because the cookie already expired. The Cookie lifetime is set to 30 days.
By accepting this agreement, you agree to the usage of Affiliate Cookies.
Limited License
The Affiliate Partner allows Platinium Group to use your website design to create the White Label website pages.
Term of the Agreement The terms of this agreement will be effective immediately. Either you or we may terminate this agreement at any time, by giving the other party written notice of termination. Upon the termination of this agreement for any reason, you will immediately cease use of, and remove from your site, all links to ticket sales, and all other materials provided by or on behalf of Platinium Group to you pursuant hereto or in connection with the program. Commission fees earned AFTER the agreement has been terminated will not be made payable and shall be declared null and void.
Exclusive Commitment
Platinium Group absorbs the development costs of creating the unique White Label ticketing and account platforms, therefore, the Affiliate Partner commits to the non-implementation of any other ticketing affiliate program (other than proposed by us), on your website for a minimum duration of 24 months, commencing from the execution of this contract agreement.
We Can Modify this Agreement
We may modify any of the terms and conditions in this agreement, at any time at our sole discretion. You will be notified by email and a change notice will be posted on the Affiliate Platform. Modifications may include, for example, changes in the scope of available referral fees, referral fee schedules, payment procedures, and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON THE AFFILIATE PLATFORM WILL CONSTITUE BINDING ACCEPTANCE OF THE CHANGE.
Disclaimer
Platinium Group makes no expressed or implied warranties or representations with respect to the program or any tickets sold through the program (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, Platinium Group makes no representation that the operation of its white label site will be uninterrupted or error-free, and it will not be liable for the consequences of any interruptions or errors.
Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commission fees paid or payable to you under this Agreement. If for any unforeseen reason the client or Platinium Group cancels a booking, commission will no longer be due to the Affiliate Partner. If the commission has already been paid, the equivalent amount will be deducted from the following commission payment.
Non-Disclosure/Confidentiality
You agree that all information including, without limitation, the terms and conditions of the Agreement, business and financial information, customer and vendor lists, and proprietary pricing and sales information that is not available to the public concerning Platinium Group shall remain strictly confidential and shall not be disclosed to any third party for any purpose.
Data privacy policy
By subscribing to the Gootickets Affiliate Program, you will receive communication and information regarding the Affiliate Program continuously. You have access to update, modify or delete your contact information by sending us an email to Affiliate@gootickets.com at any time.
